General Terms and Conditions of Vexer Verlag

Scope

Thank you for purchasing from Vexer Verlag. Your satisfaction is our top priority. If you have any questions, suggestions or if something should not work, please call us at +49 176 604 29 225 or send an e-mail to info@vexer.ch.

Please read these terms and conditions carefully as they apply to all orders. By clicking in the "I Accept / Accept" - button at the opening of an account and / or placing an order you accept the present General Terms and Conditions (GTC).

Range of Products, Prices

Our range of products is constantly adjusted. Our prices and the delivery cost participation applied to your order may change from time to time. The current range of products and prices are displayed on our website. They are subject to special promotions and individual agreements.

Booksellers are requested to contact us by phone or e-mail, so that individual conditions can be agreed.

Order

The presentation of the products in our online shop is not a binding contract offer on our part, but is only a non-binding invitation for the customer to order goods. By ordering the desired goods the customer makes a binding offer to enter into a sales contract.

When you place an order with the Vexer Verlag, we send you an e-mail with a receipt confirming your order and listing the details (order confirmation).

In providing the goods for dispatch or by deliveries oft he goods by the publisher, the sales contract is regarded as closed.

The availability of the desired product is subject to alterations at any time. We reserve the right to refuse orders without giving reasons.

Delivery

The goods are shipped properly packaged by mail or by courier to customers worldwide.

Import costs

In case of delivery from Switzerland and Germany to addresses in other countries, additional costs may be incurred (customs, VAT, service charges) on the import into the destination country. These additional costs vary according to the local laws and regulations in the destination country and the weight and value of the shipment and will be charged to the customer.

Customs and taxation in the country of destination for all items that can be ordered through this site, are always up to the customer or the recipient receiving the goods. Our logistics partners will carry out this job by order and account of the customer, who herewith authorizes and instruct our logistics partners accordingly.

Terms of payment

Customer deliveries occur only against advance payment. This can be provided as follows: PayPal, MasterCard, Visa.

Retention of title

Until full payment of the delivered goods, the merchandise remains the property of the Vexer Verlag.

Statutory right of withdrawal

Consumers in the European Union generally have a statutory right of withdrawal of 14 days.

Details of the requirements, deadlines, return costs, exceptions and consequences of withdrawal are provided on our separate “Right of Withdrawal” page.

The statutory right of withdrawal may be exercised in particular by email, letter or through our electronic “Withdraw from contract” function.

Prior registration or approval of the return is not required in order to exercise the statutory right of withdrawal.

Any mandatory withdrawal and consumer rights available to customers under other applicable laws remain unaffected.

Voluntary 30-day return policy

In addition to statutory rights, we offer consumers in the European Union and Switzerland a voluntary return period of 30 days from receipt of the goods. Where goods from one order are delivered separately, the period begins upon receipt of the final item.

For consumers in the European Union, statutory withdrawal rules apply during the first 14 days. These rights are neither restricted nor replaced by the voluntary return policy. Voluntary returns made between the 15th and 30th day are subject to the conditions set out in our separate withdrawal and return policy.

For consumers in Switzerland, the voluntary return policy applies from the first to the 30th day after receipt of the goods.

The voluntary return policy requires, in particular, that the goods are unused and undamaged and that any labels and original packaging are still present. Personalised goods and gift cards are excluded from the voluntary return policy.

Before making a voluntary return, please register it by contacting info@vexer.ch or using the “Return items” function in your customer account.

We will tell you which return address in Germany or Switzerland applies to your order.

You are responsible for the direct return costs. Original shipping charges are not refunded for voluntary returns. No processing fee is charged.

Further details are provided in our separate withdrawal and return policy. Statutory withdrawal, warranty and defect rights remain unaffected.

Warranty and Liability

We do not assume any guarantee or liability to the extent legally permissible, with the exception of the following provisions:

If the merchandise arrives damaged, we will replace it, if you let us know the latest within 24 hours from receipt of the product via e-mail and photo of the damaged goods. How to proceed with the damaged goods further, we will inform you. Please do not send us unsolicited goods back.

Merchandise with manufacturing defects or incorrect deliveries are exchanged at no cost to the customer and the cost of return will be refunded. The return must be accompanied by a copy oft he publisher’s order confirmation as well as the reason oft he return in written form.

Refunds or credits as a result of exchange or return due to damaged goods, manufacturing defects or incorrect delivery occur exclusively to the credit card account or the PayPal account, through which the payment was settled.

Confidentiality of data

We collect and process data using automatic data processing equipment in compliance with the applicable Swiss Data Protection Act. Your data is used exclusively for the proper handling of your order and to improve our product offerings and our services. Vexer Verlag will treat your data confidential and will not make it available to third parties unless it is necessary to process the data by third parties elsewhere at home or in a foreign country for operational reasons, in which the third parties are obliged to maintain confidentiality oft he data by contract. Your use of the products or services offered by Vexer Verlag is connected to your agreement with the data processing described herein.

Governing law. Place of jurisdiction

This contract is subject to Swiss law. Sole place of jurisdiction is Sankt Gallen, Switzerland.
